Booking conditions

1 Booking & Payments

1.1 The dates of your booking will be held upon payment of a non-refundable deposit of 50% or payment in full.   Deposits are only payable when booking more than 8 weeks in advance of your check in date.   Any booking less than 8 weeks in advance of your check in date must be paid in full immediately.

1.2 On receipt of the deposit, a booking confirmation will be sent to you when the payment has been processed.   Payments may be made by cheque, credit/debit cards or bank transfer.   Cheques should be made payable to J R Sutcliffe.   Please ask for bank details.

1.3 Where a deposit has been paid, full balance payment will be due 8 weeks in advance of your check in date, and a reminder will be sent to you two weeks prior to this date, where applicable, by e-mail.   If you are unable to pay the balance on or before the stated due date, you will forfeit your deposit and your booking will be cancelled.

2 Cancellation

2.1 Cancellation by you at any time will result in your deposit being forfeited, as all deposits are non-refundable.

2.2 All monies paid for a holiday (deposit and balance) are non-refundable within 8 weeks before check in date.   We recommend that you take out Cancellation Insurance to cover your intended visit.

2.3 Cancellation of any holiday after it has been paid in full and at a date 8 weeks or more in advance of your check in date, will result in forfeiture of your deposit (it being 50% of the total cost of the holiday.)   If we are able to re-let the cottage, it may be possible to refund part of the whole of the deposit.   Any refunds will be made using your original payment method.

2.4 If due to unforeseen circumstances the owners have to cancel your booking, you will of course be fully refunded.

3 Alteration

3.1 Alterations to your booking can only be made more than 8 weeks prior to the check in date, after  which time alterations will be treated as a cancellation.   All alterations are subject to availability and at the owner’s discretion.

4 Complaints

In the event that you have any complaint about your stay, please notify us as soon as possible and we will use all reasonable endeavours to resolve the issue.

5 Liability

5.1 The owners accept no liability for accident, loss of property or personal injury during your stay, and accept no liability for loss of or damage to the Guest’s possessions on the owners’s property or land.

5.2 Nothing in these conditions excludes or limits the legal liability of the owners, 1) for death or personal injury caused by the owner’s negligence, 2) for any matter which it would be illegal for the owners to exclude or attempt to exclude their liability.

6 Pets

Pets are only permitted with the prior consent of the owners, and where pets are permitted, they are to be kept under control.   We ask that guests ensure their pets are not allowed on beds or other furniture, and that any excrement in the courtyard is cleared up and disposed of.   Pets must not be left in the Property unsupervised as this could result in damage to the Property and distress to the animal.   A weekly charge may be made for each pet.

7 Guest Conditions of Occupancy and Conduct

7.1 The guests have the right to occupy the Property for the paid holiday period only ( within the meaning of Schedule 1 Paragraph 9 of the Housing Act 1988.)

7.2 Guests undertake to behave in a proper, appropriate and legal manner with due respect to the owner and property.   If any guest behaves inappropriately or improperly (of which the owner will be the final judge on their property,) the owner reserves the right to ask the guest and their party (at their discretion) to leave the property before the end of the holiday period.  Any refund for so doing will be at the entire discretion of the owner.   In addition, the owner reserves the right to sue the guest for any loss or damage to the property.

7.3 Any damage to the property and contents should be reported to the owners.   The owner reserves the right to charge for any repairs or replacements.

7.4 We ask that guests arrive after 3pm on the arrival date, and vacate the property by 10.30 on the day of departure.

8 Breach of Booking Conditions

If there is a breach of any of these conditions by the guest or any of their party, the owners or their agent reserve the right to re-enter the property and end the holiday and ask the guest and their party to leave.

9 Responsibility of Person completing the Booking Form

9.1 The person making the booking must be over the age of 18, and must agree to take responsibility for the party occupying the property, and to notify the owners if they are not a member of the holiday party themselves.

9.2 The person making the booking must read and agree with the Booking Conditions.

10 Validity Clause

In the event that a court finds that a condition in these Booking Conditions is illegal or void, the illegal or void provision will be severed from the remainder of the Booking Conditions, which will continue to be valid and have full force and effect.
